TERMS & CONDITIONS

These terms and conditions regulate the Agreement between "you" the customer and www.barneywears.co.uk (hereinafter referred to as "BW")

All goods which appear for sale on the www.tommyandrex.com web site ("the website") are advertised as invitations to treat, and no offer of sale shall be implied.

By placing an order with BW you are offering to purchase the goods detailed within that order, which BW may or may not accept at their sole discretion.

You undertake that all details you provide for the purpose of ordering or purchasing goods are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the costs of the products you are purchasing.

If for any reason your credit card details are incorrect or there is not enough money in your account or for any other reason the order cannot be processed, BW will have the right to rescind and upon their election to do so, the order will be cancelled.

If there are any changes to the details supplied by you, it is your responsibility to inform BW as soon as possible.

We may revise these terms and conditions at any time by updating this posting.

Your statutory rights are not affected by these terms and conditions. 

Ordering from us

You are deemed to place an order with us by ordering via our online checkout process. We will send you an order acknowledgement by email, detailing the products you have ordered.

Our acceptance of an order takes place when we dispatch the order to you. When we dispatch the order the purchase contract will be made even if your payment has been processed immediately unless we have notified you that we do not accept your order or you have cancelled your order for any reason.

Regrettably, sometimes we may have to refuse to accept an order:

(a) where goods are not available (although we will aim at all times to ensure the website is as up to date as possible in terms of stock levels)

(b) where we cannot obtain authorisation for your payment

(c) If there has been a pricing or product description error

(d) If you do not meet any eligibility criteria set out in our terms and conditions

(e) If the order is to be delivered outside of Mainland UK. For orders outside the Mainland UK, please contact us

In the case of international delivery, please note that BW are not responsible for any customs, import duties or tax for orders being delivered to any destination, or for any delay this may cause to your delivery as a result. These are the sole responsibility of the buyer. BW are not responsible for any damage or loss that occurs through improper shipping practices.  

Liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall BW, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Discount Codes 

From time to time, we may offer promo codes which may apply to any, or certain specified purchases made through the website. Each Promo Code will be subject to specific terms & conditions specified at the time the promo code is issued (including the length of time to use the code) in addition to those mentioned in these terms and conditions. Only one promo code can be used against an order at any one time. A promo code can't be applied to an order after that order has been placed. ​
